auXync Pty Ltd ("we", "us", or "our") operates the auXync mobile application (the "App"), available on the Google Play Store and Apple App Store. This Privacy Policy explains how we handle information in connection with your use of the App.
We are committed to protecting your privacy and complying with applicable privacy laws, including the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs), the EU General Data Protection Regulation (GDPR), and the privacy requirements of Google Play and the Apple App Store.
The App may access or process the following types of data solely to deliver its core functionality:
Location data (GPS): Used to synchronise audio/visual elements with your environment, which is the App's core advertised function. All location data is anonymised automatically and does not contain any personally identifiable information.
Audio: Used solely for the purpose of synchronising audio elements as part of the App's core function. Audio data is anonymised automatically and is not linked to any identifiable individual.
Camera: Used to enable the App's augmented reality (AR) experience on your device. Camera data is processed entirely on-device and is never transmitted off your device or shared with any third party.
Device identifiers: Any device-level identifiers accessed by the App are anonymised automatically and are not used to identify you personally.
Sensor and interaction: The App may process device sensor data, including gyroscope-based interaction data, solely to support interactive features, audience engagement functions, and the App’s core experience. Where collected, this data is used in anonymised form and is not used to identify you personally.
Optional audience feedback and surveys: The App may invite users to provide optional feedback, including star ratings and free-text survey responses. Providing this feedback is entirely voluntary, and users may skip or exit any survey at any time. Feedback is used only to evaluate audience experience, improve performances and presentations, and enhance the App, and may be transmitted in anonymised form to a secure server on a local network for analysis.
We do not intentionally collect your name, email address, or other directly identifiable personal information through the App. If a user voluntarily includes personal information in optional free-text survey feedback, that information will only be handled in accordance with this Privacy Policy and will not be used to identify the user unless required by law.
All data accessed by the App is used solely for the purpose of enhancing the user experience, including providing and improving the App's core functionality—accurate synchronisation of audio and visual elements and the delivery of AR experiences. Specifically:
Location and audio data, where requested, are used only to ensure accurate real-time audio/visual synchronisation and anonymised data analysis of listener for optimising app-usage and audience experience.
Camera data is used only for on-device AR interactions.
Audience interaction and feedback, including gyroscope-enabled features and any optional audience feedback and surveys, are used only to optimise app usage and user experience, to compile anonymised time-based audience insights and trends related to performances and presentations, to inform broader enhancements to future performances and presentations, and to improve the App.
No data is used for advertising, user profiling, or any purpose unrelated to the App's core function.
We do not sell, rent, or share your data with third parties, except:
Service providers: We may use trusted third-party service providers (such as analytics or crash-reporting tools) who assist us in operating the App. These providers are contractually required to handle data securely and only as directed by us.
Legal requirements: We may disclose information if required to do so by law or in response to a valid legal request.
Any data shared with service providers is anonymised and does not contain personally identifiable information.
We implement appropriate technical and organisational measures to protect any data processed through the App. Camera data used for AR features is processed on-device and is not transmitted off your device. Other operational data, including location data, device identifiers, sensor and interaction data, and optional audience feedback and surveys, may be transmitted in anonymised form to a secure server on a local network for analysis and to improve the App and related performances and presentations.
Raw anonymised operational data stored on our secure systems is kept for up to eight (8) years, after which it is securely erased or retained only in further de‑identified and aggregated form. Reports, statistics, and insights derived from this anonymised data may continue to be used after raw data has been deleted, but they do not contain information that can reasonably identify an individual.
If you access the App from the European Union or European Economic Area, we comply with the requirements of the GDPR. The legal basis for any data processing is our legitimate interest in delivering the App's core synchronisation and AR functions, and in ensuring the App operates correctly. Where required, we will seek your explicit consent.
The App is not directed at children under the age of 13 (or under 16 where required by applicable law). We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us and we will take steps to delete it.
Depending on your location, you may have the right to:
Access the personal information we hold about you
Request correction or deletion of your information
Object to or restrict certain processing
Withdraw consent at any time (where processing is based on consent)
Lodge a complaint with your relevant data protection authority
